Conditions of Use

  1. Acceptance of terms and conditions
    By creating an account with us, you are accepting these terms and conditions. If you do not accept these terms and conditions, you must refrain from using our online services.
  2. Valid contact lens prescription
    You may only order contact lenses through this web site if you have a valid and up to date contact lens prescription. This means that you have attended all appointments and follow up appointments as recommended by your optometrist. Most optometrists advise a follow up examination every year if you are wearing contact lenses regularly, though it may be more or less than this depending on the lens type and wearing schedule.
  3. Contact Lenses can be Harmful to your eyes
    You understand that using contact lenses incorrectly, or using contact lenses that are not prescribed for you, may result in harm or damage to your eyes or vision. You agree to visit your optometrist as regularly as advised, this is normally at least once per year. If any problems occur such as pain or discomfort, you must remove your contact lenses immediately and consult us or your regular optometrists. You should never wear contact lenses if you suspect you may have an eye infection.
  4. Prescriptions from another optometrist
    If your prescription is not with us, and you provide the name of your own optometrist, then you are authorising us to obtain you prescription details from that optometrist. We will use the prescription details to check what you are ordering is correct and that you are up to date with your follow up examinations.
  5. Order cancellation
    Highbury Optometrists Ltd reserves the right to cancel any orders. Reasons for cancellation may include, but are not limited to inappropriate use of the shopping site, circumstances where we believe payment details may be fraudulent, insufficient information is provided for us to process the order. If you order is cancelled, you will be notified by email and you will not be charged.
  6. Termination of membership
    Highbury Optometrists Ltd reserves the right to suspend or delete your user account if we have reason to suspect that you have breached any of the terms or conditions.
  7. Accurate information
    You agree that all information provided when ordering and creating your account is correct. It is your responsibility to ensure your details are up to date when placing an order. You may not to register under multiple identities. Highbury Optometrists Ltd may delete additional accounts that we believe belong to the same person.
  8. Jurisdiction
    All parties agree that New Zealand courts will be vested with jurisdiction in the event of any dispute arising from this agreement or the use of this web site.
  9. Applicable law
    All parties agree that this agreement is governed by the law of New Zealand and that the law of New Zealand will apply to any dispute arising from this agreement or use of this web site.
  10. Shipping
    Delivery times may vary, for most products the estimated delivery time is noted in the product details section. Sometimes a particular item may not be in stock with us or the NZ distributor, in this case the item may have to be backordered which can take a lot longer. If your item has to be backordered we will notify you and you can cancel the order without penalty if you wish.
    We will deliver to a PO BOX if at all possible.
    We deliver in New Zealand and can also deliver to Australia and the UK. An additional delivery charge may apply to Australia and the UK.
    There is no delivery charge for orders shipped within New Zealand. Delivery charges apply for shipping outside New Zealand.
  11. Returns
    Any item that you are not happy with must be returned within 10 days. The item must be undamaged and must reach us in its original condition and in its original packaging. You are responsible for the cost of returning the item to us.
    If the goods are faulty or incorrectly shipped you need to notify us within 10 days and we will send a pre-paid courier pack in which you can return the goods.
    Once you have returned the goods you can get a refund or a credit. We will either refund you by the same method in which you paid, or apply a credit to your account.
